If you have suffered a serious injury that was someone else’s fault, you may have questions about your legal rights. We’ve got answers.
In order to have a successful personal injury claim, you must be able to prove all the required elements of a claim:
A personal injury attorney can help you determine if you have a claim worth pursuing.
You pay nothing up front, and almost always nothing at all unless your lawyer recovers money for you. If your case is successful, your lawyer is paid a percentage of your recovery.
In most cases, you have up to three years to file a lawsuit after an injury in Massachusetts; that is called the “statute of limitations.” However, in some cases, such as when you are suing a city or municipality, you may have only a very short time to file a claim and must follow special rules to do so. It’s best to schedule a consultation with an attorney as soon as possible even if you have time left to file a claim, because otherwise evidence may be lost or witnesses’ memories may fade.
You may still be able to recover damages for your injuries even if you were partly at fault for the accident. Massachusetts recognizes the legal principle of “modified comparative negligence.” That means that the amount you can recover is reduced by the percentage of your fault. For example, if your damages are $100,000, but you were 20% at fault for the accident, you could recover up to $80,000. However, if you were more than 50% at fault for the accident, you would recover nothing.
The value of your case depends on a number of factors, including economic damages like medical expenses, lost income, and loss of earning capacity and non-economic damages like pain and suffering and loss of enjoyment of life. Your lawyer may work with expert witnesses to help prove the value of your case to the court.
It’s also impossible to know the true value of an injury case until you have reached maximum medical improvement (MMI). If you settle your case too soon, you may miss out on compensation for complications you didn’t expect.
Insurance companies don’t settle cases out of the goodness of their hearts. They do it to avoid lawsuits and the possibility of a large verdict against them. All they care about is saving money—not you. If you accept a settlement, you release any future claims you may have, even if your injuries turn out to be much worse than you first thought.
A personal injury lawyer deals with the insurance company on your behalf, preventing you from making an innocent statement the insurer could use against you to claim that you were at fault. Insurance industry research has also indicated that injury victims who are represented by a lawyer receive settlements about 3.5 times greater than those who are not. And if your case must go to trial, your lawyer will stand up for your rights in the courtroom.
